1. Introduction

Welcome to Floating(“we”, “us”, “our”). These Terms and Conditions govern your use of our website, floating.tools, and the services provided through it — an assessment platform where organizations evaluate how candidates complete real work with an AI assistant. By accessing or using Floating, you agree to comply with and be bound by these terms.

2. User Eligibility

To use our services, you must be at least 18 years old and capable of forming legally binding contracts. By using Floating, you represent and warrant that you meet these eligibility requirements. This applies both to hiring-team users and to candidates taking assessments.

3. Account Registration

Hiring-team users must create an account to author tests and review results. You agree to provide accurate and complete information during the registration process and to update your information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Candidates do not create accounts. A candidate accesses an assessment through a unique invitation link and identifies themselves with their name and email address. Invitation links are personal; do not share them.

4. Candidate Assessments

Assessments are timed work sessions inside a recorded workspace. By starting an assessment, you acknowledge that:

• The work you produce — including documents, whiteboard content, your conversation with the AI assistant, and workspace interaction events — is recorded and shared with the organization that invited you, together with AI-assisted evaluations of that work.
• Sessions are subject to the time limit and AI-usage allowance configured for the test, and end automatically when either runs out.
• Floating produces scores and evidence only. Hiring decisions are made by the organization that invited you, not by Floating.

5. User Responsibilities

You agree to use Floating in compliance with all applicable laws and regulations. You are responsible for ensuring that the information you provide is accurate and truthful. Organizations are responsible for the content of the tests they author and for having a lawful basis to invite candidates and process their assessment results.

6. Prohibited Activities

You may not use Floating for any unlawful or prohibited activities, including but not limited to:

• Engaging in fraudulent activities
• Posting or transmitting unlawful, defamatory, or obscene content
• Interfering with the operation of the website
• Attempting to access assessment sessions, tests, or results that belong to another person or organization
• Attempting to circumvent assessment integrity, time limits, or AI-usage allowances
• Using the AI assistant for purposes unrelated to the assessment or for unlawful purposes

7. Intellectual Property Rights

All content on Floating, including text, graphics, logos, and software, is the property of Floating or its licensors and is protected by intellectual property laws. You may not use, reproduce, or distribute any content from Floating without our express written permission.

8. Content Ownership and Use

Users retain ownership of any content they submit to Floating — tests and briefs authored by organizations, and work produced by candidates during assessments. By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to host, display, and process your content as needed to operate the service, including processing it with AI models to produce evaluations and making candidate submissions and results available to the inviting organization.

9. AI-Generated Content and Evaluations

Floating uses AI models to power the in-workspace assistant and to evaluate assessment sessions. AI-generated output may be inaccurate or incomplete. Evaluations and scorecards are advisory: they are intended to support, not replace, human review, and the final interpretation and any hiring decision rest with the organization that commissioned the assessment.

10. Limitation of Liability

Floating is provided on an “as-is” and “as-available” basis. We disclaim all warranties, express or implied, regarding the website and its content. We shall not be liable for any damages arising from your use of Floating, including decisions made by organizations based on assessment results.

11. Dispute Resolution

Any disputes arising out of or relating to these Terms and Conditions or your use of Floating shall be resolved through binding arbitration in Bucharest, Romania. You agree to waive any right to a trial by jury or to participate in a class action.

12. Changes to the Terms

We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on this page, and the “Last Updated” date will be revised. Your continued use of Floating after any changes constitutes your acceptance of the new terms.

13. Termination of Services

We may terminate or suspend your account or assessment session at our sole discretion, without notice, for conduct that we believe violates these Terms and Conditions or is harmful to other users or us.

14. Governing Law

These Terms and Conditions are governed by the laws of Romania. Any legal actions or proceedings related to Floating must be brought exclusively in the courts located in Bucharest, Romania.
